APPROVAL OF VOLUNTARY ANNEXATION OF PROPERTY OWNED BY IHK HOLDINGS LLC (AX18-34) - Located at 8800 66th Street

NOTE: This is a voluntary annexation of 0.21 acres MOL of contiguous commercial property located at 8800 66th Street. For one (1) year from the date of execution of this Agreement, the City shall waive land development fees applicable for future redevelopment of the property, in an amount not to exceed Three Thousand Dollars ($3,000). The parties acknowledge and agree that the existing use of the Owner's property, which includes some outdoor storage of landscape equipment and accessories, shall be treated as a nonconforming grandfathered use, subject to the applicable provisions of the City's Land Development Code. However, such nonconforming use shall not be enlarged or expanded from its current condition. The City shall accept the existing building structures (including outside storage areas) on the Property in their "as-is" condition, except that Owner shall maintain said structures in good repair. At the time said structures are proposed for renovation or alteration, Owner shall then bring the structures into compliance with applicable building codes. The Parties understand and agree that building issues will be subject to all applicable codes if not specifically addressed in this Agreement. As part of the consideration of this Agreement, the City shall treat the existing structures, in their present locations, as being grandfathered. The City's annual projected revenue is Two Thousand Three Hundred Sixty Six Dollars ($2,366) and no City funds were expended.
